#vivogiveitashot Activity
“#vivogiveitashot Activity” (the “activity”) is organized and promoted by vivo and is subject to the following terms and conditions.
To participate in the activity, follow the instructions and accept the following terms and conditions, which will form a binding agreement between you and vivo Mobile Communication Co., Ltd. (“vivo”)
How to Participate
1.1 The activity is from Oct. 10th, 2022 to Nov. 16th, 2022. Participation in this activity is free of charge and is open to all end users of Instagram.
1.2 You need to share post(s) on Instagram with clickable #vivogiveitashot hashtag in the post caption. You can submit more than one creative work in one post with the required hashtag #vivogiveitashot. Each Participant can win a maximum of one prize for the giveaway. The account must be made public so the submission is visible to vivo.
1.3 Sharing post(s) on Instagram with #shotonvivo if you use a vivo phone to take the photo. And you are encouraged to use #vivogiveitashot which makes your post(s) more identifiable.
1.4 vivo will choose final 10 winners, and the final results will be announced on vivo’s social media channels.
1.5 The prize will be announced by vivo account’s announcements.
1.6 The official vivo global account will contact you directly through Instagram’s messaging system. Please check your messages frequently to avoid missing out! If you cannot reply within 72 hours, vivo will consider this as a waiver.
1.7 By participating in the activity, you consent to give vivo a royalty-free, irrevocable, non-exclusive license to use, copy, adapt, reproduce, publish and display such creative works in whole or in part, on a worldwide basis, in any form and media for purposes of implementing the activity.
Prize
2.1 In cases where a prize cannot be delivered due to causes originating with the winner (including but not limited to failure to provide contact information, submission of incomplete or inaccurate contact information that prevents vivo from establishing contact) the prize will automatically be considered waived. vivo assumes no responsibility for any such outcome and will not reissue the prize in such cases.
2.2 Prizes may not be exchanged for cash. If unforeseen circumstances prevent the distribution of a prize, vivo reserves the right to issue an equivalent prize of same or similar cost in its place. Replacement awards may not be exchanged for cash.
2.3 Prize recipients shall bear full responsibility for any personal income taxes incurred with their prizes. vivo shall bear full responsibility for any domestic or international shipping charges incurred by the delivery of the prize.
2.4 Once prizes have left vivo’s premises, vivo takes no responsibility for prizes damaged, delayed or lost in transit.
2.5 If the prize is vivo’s product and not launched and/or available in your country or region, vivo will deliver the prize to you, however, vivo stores in your country or region will not be able to provide after-sales service for the products which are not launched in your country or region.
Miscellaneous
3.1 You understand and agree that not all the giveaways can be delivered successfully due to the requirements of applicable laws or logistical problems in certain countries or regions. In such an event, vivo has the right to suspend such giveaways without any legal liabilities.
3.2 By participation, you warrant and represent the following: (a)you are eligible under your local law to participate in this activity; (b) you are the sole and exclusive owner of the submitted post(s) or you are authorized; (c) your submitted post(s) will not infringe on any proprietary rights, intellectual property rights, industrial property rights, personal or moral rights or any other rights, including without limitation, copyright, trademark, trade names, industrial designs, patent, trade secret, privacy, publicity or confidentiality obligations; (d) any third parties appearing in the submitted post(s) have given you appropriate consent to be photographed and used as permitted herein; (e) Submitted post(s) must not violate any applicable laws.
3.3 Your submitted post(s) must not be derogatory, offensive, threatening, defamatory, disparaging, libelous or contain any content that is inappropriate, sexual, profane, tortuous, slanderous, discriminatory, or promotes hatred or harm against any group or person, contain any illegal information of a political, pornographic, or violent nature or which may be deemed to support terrorism, include any disparaging remarks relating to vivo or a third party, or is disruptive to public social order and morality or otherwise does not comply with the theme and spirit of this activity.
3.4 You agree to indemnify vivo and its officers, directors, employees, agents, distributors and affiliates from and against any and all third-party claims, demands, liabilities, costs or expenses, including reasonable attorneys’ fees, resulting from your breach of article 3.2 and 3.3 of the Rules.
3.5 The terms and conditions may be available in different languages, you agree the English version vivo announces through its official channel shall prevail to the extent of any inconsistencies.
Privacy and Data Protection
4.1 vivo will collect Personal Data (including name, phone number, and mailing address) from each winner for the purpose of delivering their prize. vivo will retain such personal data for the period necessary for the above purpose of processing, or as required by you or applicable laws. Once the retention period expires, vivo will delete or anonymize your personal data, unless otherwise required by applicable laws and regulations.
4.2 vivo will not sell, share or otherwise disclose Personal Data of winners with third parties, other than to third parties engaged by the vivo to fulfill the above purpose. Your name, phone number, and mailing address may be encrypted and transferred to AGENDA (Beijing) Limited Guangzhou Branch (vivo’s social media operation service provider in China). Please be aware that vivo has signed a data protection agreement with the aforementioned service provider(s) and they will provide protection for your data at a standard that is no less than vivo’s. Otherwise, vivo will only share your data when required in response to a legal process or request from a competent authority according to applicable laws. Since vivo operate internationally, your personal data may be transferred to or accessed by vivo's entities around the world. vivo comply with laws on the transfer of personal data between countries to help ensure your data is protected, wherever it may be.
